Welcome to Branded By Kayla. These Terms of Service (“Terms”) govern your access to and use of our website, services, digital products, and any design-related work provided by Branded By Kayla (“Company,” “we,” “our,” or “us”).

By purchasing a product, booking a service, or accessing this site, you agree to be bound by these Terms.

1. Custom Design Services

All design products, branding assets, and AI-enhanced imagery are created specifically based on the client’s submitted preferences and requirements.

Clients agree to:

  • Provide clear and accurate design details when placing an order

  • Approve preview proofs in a timely manner

  • Understand that final delivery timeframes depend on prompt responses and accurate information

We reserve the right to decline any design request that violates copyright, trademark, discriminatory, or inappropriate content standards.

2. Digital Product Policy

All digital products, templates, artwork, and downloadable files are delivered electronically and are non-returnable.

Unauthorized sharing, reselling, or distributing our digital content is strictly prohibited.

3. No Refunds / No Returns

All sales are final.
This applies to:

  • Custom designs

  • Templates and downloadable files

  • AI photo services

  • Branding packages

  • Rush fees

Once work has started or files have been delivered, no refunds will be granted under any circumstance.

4. Revisions & Design Changes

Orders include up to 3 revision rounds unless otherwise stated.
Additional edits, major redesigns, or changes requested after approval will incur additional fees.

Failure to provide revision notes within the agreed timeline may result in project delays or closure.

5. Art Approval & Final Delivery

Before final delivery, clients will receive preview images to approve. By giving approval:

  • The client confirms all spelling, branding, and visual elements are correct

  • Any errors found after approval are the responsibility of the client

  • Additional changes after approval may require a new order or fee

Final files are delivered in digital form only. We are not liable for printing errors if the approved files contained inaccuracies.

6. Turnaround Times

Estimated turnaround times are provided but may vary depending on:

  • Client responsiveness

  • Project complexity

  • Order volume

  • Holidays or peak seasons

Rush delivery is available at an additional fee when capacity allows.

7. Intellectual Property Rights

All artwork, designs, drafts, and concepts remain the intellectual property of Branded By Kayla until the project is paid in full and officially approved.

Clients receive a commercial-use license for final approved artwork only.

Clients may not:

  • Alter work themselves

  • Resell or redistribute files

  • Claim ownership of raw layered files (unless purchased)

We retain the right to showcase completed work for marketing and portfolio purposes unless otherwise agreed in writing prior to project start.

8. AI-Enhanced Imagery Disclaimer

AI tools are used to assist and enhance the creative process. Due to the nature of AI:

  • Exact anatomical or facial replication is not guaranteed

  • Each generation may vary in style, features, and detailing

Clients acknowledge that AI outputs are an artistic approximation.

9. Communication

Primary communication is handled via:

Failure to respond within 7 business days after file delivery or approval request may result in order closure without further obligation from Branded By Kayla.

10. Chargebacks & Payment Disputes

Submitting a chargeback after receiving services or digital goods is considered fraud.

We will provide all evidence of delivery, communication, and approvals to your bank or payment processor. Accounts involved in fraudulent activity may be restricted from future services.

11. Liability Disclaimer

Branded By Kayla is not liable for:

  • Loss of profit, revenue, or brand recognition due to design choices made by the client

  • Delays caused by client inaction or inaccurate information

  • Misuse or alteration of delivered files

We reserve the right to refuse or cancel services for any reason at our discretion.

12. Governing Law

These Terms are governed by and interpreted under the laws of the State of Nevada. Any disputes shall be handled exclusively through arbitration or a court of jurisdiction in that state.

13. Terms Updates

We may update these Terms from time to time. Continued use of our services constitutes acceptance of the updated Terms.
